It might be difficult and complex to apply for Canada’s LMIA. In order to hire from the international market, employers in Canada must first obtain authorization from the federal government. LMIA is the name given to this type of permission (Labour Market Impact Assessment).

Employers must demonstrate that they are unable to hire from within Canada because they lack the appropriate skills and talents. Employers must wait for approval in the form of a confirmation letter or LMIA after submitting an application for LMIA.

If the employee has a valid job offer, contract, LMIA copy, and LMIA number, he must apply for a work permit after receiving the LMIA.

What are the New LMIA Rules for 2022 in Canada?

The LMIA procedure has seen some adjustments in recent years. Job positions are now classified into two major groups, according to the recent updates: high-wage occupations and low-wage jobs.

It is a high-wage job if the salary is equal to or greater than the median salary in the area where the job will be done, and it is a low-wage job if the salary is less than the median salary. The application fees have also increased significantly, with each worker now costing $1,000.

What are the LMIA Requirements?

The hiring of High-Wage Employees: When a business hires a temporary foreign worker at a higher wage than the median wage, the employer must implement a transition plan, which is a legal requirement.

Hiring Low-Wage Workers: A transition plan is not required when a firm hires a temporary foreign worker at a low wage. There is a limit to how many low-wage workers a company can hire. When an employer has more than 10 employees, they are only allowed to hire low-wage TFW up to 10% of the time.

If LMIA is required, staff will be hired as follows: Once the LMIA has been awarded, each TFW must obtain a copy of the confirmation letter and then apply for a work visa.

Recruiting workers if LMIA isn’t required: Employers can hire TFW without an LMIA through the International Mobility Program (IMP). Employers must pay an employer compliance fee, and an offer of employment form must be submitted through the Employer Portal.

LMIA Processing Time: There are delays in processing times due to the large volume of LMIA applications, particularly in the TFW program. Below are the most recent processing times for each LMIA program:
